Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Models of Care Portal ("Portal"), including any information, text, graphics, photos or other materials uploaded, downloaded or appearing on the Portal (collectively referred to as “Content”). Your access to and use of the Portal are conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms.

These terms have been updated in line with relevant legislation, including the EU General Data Protection Regulation (GDPR) which took effect from 25 May 2018.

General Terms

You are responsible for your use of the Portal, for any Content you post to the Portal, and for any consequences thereof. Most Content you submit, post, or display is public by default and will be able to be viewed by other users. All content, whether publicly posted in the Portal area or privately posted in the Forum, is the sole responsibility of the person who originated such Content.

We may not monitor or control the Content posted and, we cannot take responsibility for such Content. Any use or reliance on any Content or materials posted via the Portal or obtained by you through the Portal is at your own risk.

Access to your information

We want to make sure that your personal information is accurate and up-to-date. You have the right to request a copy of the information that we hold about you, and can ask us to correct or remove information you think is inaccurate. If you would like a copy of some or all of your personal information, please email or write to us at the address below.

Cookies

Cookies are text files containing small amounts of information which are downloaded to your device (your computer, mobile phone, tablet etc.) when you visit a website. They are useful because they allow the website to recognise your device and store information such as your preferences and search history. Most websites use cookies.

Public Users

Definition - "Public Users" are those that use the Portal without a registered account. This provides the right to view Content but not submit, post or display Content on the Portal. Your License to use the Portal - the South West Academic Health Science Network (“SWAHSN”) gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the Portal. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Portal as provided by SWAHSN, in the manner permitted by these Terms. Your rights - As a public users of the Portal you do not have the right to submit, post or display any Content on the Portal. Your rights extend to the viewing of Content only.

Registered Users

Definition - "Registered Users" have an account registered with the Portal providing them the right to submit, post and display Content on the Portal. Registered Users accounts are limited to healthcare staff and the allocation of such accounts is controlled by SWAHSN. Your License to use the Portal - SWAHSN gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the Portal. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Portal as provided by SWAHSN, in the manner permitted by these Terms.

Your rights - You retain your rights to any Content you submit and post on the Portal. By submitting and posting Content on the Portal, you grant us a worldwide, non-exclusive, royalty-free license to display such Content on the Portal.

Restrictions on Content - We reserve the right at all times (but will not have an obligation) to remove or refuse to distribute any Content on the Portal, to suspend or terminate users, and to reclaim usernames without liability to you. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of SWAHSN , its users and the public.

Passwords - You are responsible for safeguarding the password that you use to access the Portal and for any activities or actions under your password. We encourage you to use 'strong' passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. SWAHSN cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

Intellectual Property

The Portal is protected by copyright, trademark, and other laws of the United Kingdom. Nothing in the Terms gives you a right to use the Models of Care Portal name, logos, domain name, and other distinctive brand features.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way.

Any feedback, comments, or suggestions you may provide regarding the Portal is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit to improve the user experience and without any obligation to you.

Ending these Terms

You may end your legal agreement with SWAHSN at any time for any or no reason by deactivating your account and/or discontinuing your use of the Portal. You do not need to specifically inform SWAHSN when you stop using the Portal.

Limitation of Liability

To the maximum extent permitted by applicable law, SWAHSN shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, good-will, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Portal; (ii) any conduct or content of any third party on the Portal, including without limitation any defamatory, offensive, or illegal conduct of other users or third parties; (iii) any content obtained from the serves; or (iv) unauthorised access, use or alteration of your transmissions of Content.
